Firehouse Subs Appeals Court Order in Favor of Calli Baker’s Firehouse Bar
and Grill

FranchiseKnowHow has reported on the litigation between Firehouse Subs
and Calli Baker’s Firehouse Bar and Grill. Following is the latest on this
ongoing battle as reported by Heath Scurfield, owner of Calli Baker’s Firehouse
Bar and Grill.
Firehouse Restaurant Group, the parent company of Firehouse Subs, has decided to
appeal a Jury verdict rendered against them on August 19 2011, and a judge’s
order of October 17, 2011. An eight person jury in a U.S. District court
in Florence, SC found that Firehouse Restaurant Group did commit fraud on the
United States Patent and Trademark Office when they filed a trademark
application for the word mark “FIREHOUSE” in 2003. They also found that
Calli Baker’s Firehouse Bar and Grill, and its owner Heath Scurfield, did not
infringe on any of their current active 34 trademarks. On October 17,
2011, Federal Judge Bryan Harwell denied Firehouse Restaurant Groups motion for
a new trial, and ordered the company to pay approximately 251,000 dollars in
attorney’s fees to Scurfield.
Firehouse Restaurant Groups action today will move the issue to the 4th
Circuit Court of Appeals in Richmond, Va. No future court date has been
set, but it is expected to take years to make it through the court system.
Firehouse Restaurant Group has also challenged the District Court's award of
attorney’s fees and costs to Scurfield, and Calli Baker’s Firehouse.
“Their decision disappoints me,” says Scurfield, “but we just have to accept
it, and continue on with the process. I know I have done the right thing
defending myself for the last three years, and I will continue to do so.
The continued support I receive from customers and the public at large will give
me the strength to see this through.”
Heath Scurfield is the sole owner of Calli Baker’s Firehouse Bar & Grill. The
restaurant is located at 10131 N. Kings Hwy, in front of the Colonial Mall.
