DLA Piper Reports on Changes to Georgia Franchise Law.

DLA Piper, reports on Governor Nathan Deal of Georgia signing House Bill 30 into law on May 11th. The Bill is intended to resolve some uncertainty regarding recent legislative efforts to reform Georgia's restrictive covenants law. The original bill dealt with non-compete and non-disclosure provisions in a manner that many felt, including the IFA, weakened franchisor rights. There is some uncertainty regarding the effectiveness of the law and changes, regarding franchisees that had previously executed franchise agreements. A key change in the new law removes the obligation from judges to strike for example,onerous non-compete provisions from a franchise contract. However, Judges still have the discretion to strike these clauses. To learn more about this important issue click here.
